Abstract | Counterfeiting and piracy pose significant threats to global trade, intellectual property (IP) rights, and public safety, prompting the establishment of international treaties to combat these illicit activities. This paper examines the role of international treaties, particularly the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS), in combating counterfeiting and piracy in India and the United States. Through a comparative analysis, the study explores the compliance levels of both countries with these global agreements, highlighting the challenges and successes in implementing their provisions. The research delves into the effectiveness of international frameworks in fostering legal cooperation, enhancing enforcement mechanisms, and providing capacity-building for nations with weaker legal systems. Additionally, the paper evaluates the role of regional agreements and bilateral treaties in complementing global efforts. A focus is placed on the institutional frameworks in India and the USA, their legislative measures, and the effectiveness of their enforcement agencies in curbing counterfeiting and piracy. This study also addresses the socio-economic implications of counterfeiting and piracy on both economies, including the loss of revenue, job opportunities, and the erosion of consumer trust. By analyzing case studies, the paper offers insights into the strengths and weaknesses of the international legal system in combating these pervasive crimes and provides recommendations for strengthening compliance mechanisms. |
